Corps Proposes Reissue of RGP in North Dakota

The U.S. Army Corps of Engineers Omaha District proposes to reissue Regional General Permit (RGP) 96-01 for work associated with emergency flood related activities. The Corps proposes to reissue this RGP for a period of five years, with the expiration date of April 30, 2024. The Corps is will receive public comments on the proposal until April 17.

This RGP, if reissued, could authorize emergency projects in any waters of the United States in North Dakota. Authorized activities would include, but are not limited to, repair, construction and reconstruction of new and existing roads; temporary levee construction; levee repair; breach closures; bridge embankment repair; protection and/or repair of utility structures; placement of suitable rock and/or dirt fill for bank stabilization; and the construction of temporary drainage ditches to facilitate the removal of flood water, sheetwater, or excess water.

The guidelines of the RGP are used to evaluate the discharges of dredged or fill material in waters of the United States. Fundamental to the guidelines is an understanding that dredge or fill material should not be discharged into U.S. waters unless it is demonstrated that such discharges would not adversely impact the environment.

Anyone whose interests may be affected by the reissuance of this RGP is invited to submit favorable or unfavorable written comments to the U.S. Army Corps of Engineers, North Dakota Regulatory Office, 3319 University Drive, Bismarck, North Dakota 58504 or electronically to CENWO-OD-R@usace.army.mil.
